A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law. You agree not to share or transfer your password or other Account access information with any other party, temporarily or permanently. You shall bear sole responsibility for all use and activities of your Account and for the confidentiality of any passwords you create to access this Site. Should you notice any unauthorized use of your Account, contact MandalayGazette.com immediately at help@MandalayGazette.com. MandalayGazette.com will not be responsible for any losses that you may incur as a result of someone else using your Account. Each person may only open one (1) Account. To contribute to the Site, you must be at least 13 years of age or older.
Once you have created your Account, we encourage you to fill out your “About Me” page with your background information and links to your favorite sites, including your blog or website. We also encourage you to include information about other publications or articles you have written, such as books you have authored, including information about how visitors can purchase your works, whether literary or non-literary. Included information must comply with this Agreement and applicable law.
In order to maintain MandalayGazette.com as a trusted platform, we reserve the right to cancel the Account of members who engage in fraudulent behavior or other unacceptable activities contrary to this Agreement. In the event that MandalayGazette.com cancels your Account or your access to this Site because of fraudulent or other unacceptable activities (as defined by MandalayGazette.com) contrary to this Agreement (including but not limited to registration with multiple accounts, posting copyright violations, posting duplicate articles under different titles on the site, attempted manipulation of the MandalayGazette.com rating system, generation of artificial traffic, or other violations of this Agreement, the law, or the legal rights of a third party), you agree that the license granted herein to content submitted by you shall not terminate, but you will agree to forfeit all rights you may have to your Account and to any then accrued or future earnings from the Site or by MandalayGazette.com with respect to any material you previously submitted. If MandalayGazette.com cancels your account, and you feel this was done in error, please contact us at help@MandalayGazette.com.
2. Your privacy on MandalayGazette.com

By using MandalayGazette.com, you consent to our collection, use, and disclosure of the information you give to us in accordance with the Privacy Policy. 3. Rights to submitted articles and other content
By submitting content to the site, you agree to give MandalayGazette.com 1 year exclusive online rights and perpetual non-exclusive rights to this content. The one year exclusive clause does not apply to content submitted to the Creative Writing channel. MandalayGazette.com does not claim copyright ownership of the content you publish on the Site. After publishing content on the Site, you (or a third party who permitted you to publish their content on the Site) continue to retain all copyright ownership to the content, subject to the license terms described herein. After 1 year you regain the right to use the content in any way you choose. In exchange for your services and granting MandalayGazette.com a license to use your content, MandalayGazette.com provides you with earnings and recognition as defined herein.
Grant of license: By submitting your content to MandalayGazette.com, you grant MandalayGazette.com (and any MandalayGazette.com successors-in-interest, subsidiaries, or parent companies), a worldwide, perpetual, irrevocable, transferable, non-exclusive, sub-licensable right and license to, in whole or in part, with or without attribution to you, use, copy, modify, edit, adapt, publish, publicly display/perform, translate, display, create derivative works from and/or license and/or distribute content posted to the Site. Per above, you grant MandalayGazette.com: a one-(1) year exclusive online right and license (with exception to content written to the Creative Writing channel) to the content you submit to the site.
Your representations and warranties regarding content: You represent that all statements you assert as fact are factual. You represent that the content you provide to MandalayGazette.com does not contain any viruses, Trojan horses, worms, time bombs, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information in or connected to MandalayGazette.com.
4. Site usage requirements
When you read or in any other way use the content (that is not of your own creation) on MandalayGazette.com, you agree to the following site usage requirements:

Any misconduct by you, including attempts to manipulate the rating of content on MandalayGazette.com will result in your immediate exclusion from MandalayGazette.com and the cancellation of your Account, at MandalayGazette.com’s sole discretion.
Agreement not to generate artificial traffic: Any attempt by you to generate higher traffic to articles or other submitted content (whether submitted by you or by a third party) by using automated means like “pay to surf” websites, robots, spiders, auto-spawning of browsers, automatic redirecting of visitors, blind text links, misleading links, forced clicks, etc., will also result in the immediate cancellation of your Account by MandalayGazette.com. In case of the cancellation of your Account, any rights you may have to your Account and any non-paid or future revenue streams you may have otherwise been entitled to earn will be terminated.
Allowed and encouraged site and article linking and marketing: Although using automated robots, spiders, or “pay to surf” techniques to increase traffic to MandalayGazette.com and your articles is strictly prohibited, MandalayGazette.com does actively encourage its members to link to MandalayGazette.com and your articles directly from your blog, discussion forums, groups, chat rooms, and other websites. The more we all link to MandalayGazette.com and the more we all market MandalayGazette.com and our content, the faster MandalayGazette.com will grow.
5. Activity payment structures: Ad revenue share, Incentive Pay, Rating Bonus, Content Source, Stock Content and Contests.
MandalayGazette.com offers several ways for members to earn through their participation: Revenue Share, Incentive Pay, Rating Bonuses and Writing Contests.
Ad Revenue Share: MandalayGazette.com shares its ad revenue with its active members based on their level of activity and value that each member brings to the Site. MandalayGazette.com’s revenue sharing model is based on the value you provide to MandalayGazette.com, and as such, MandalayGazette.com operates as a co-op. As the site continues to grow in quantity and quality of content, the ad revenue increases and the ad revenue share with our members increases.
As long as members remain active on the Site, their revenue share earnings continue to accrue. Members’ Accounts become “dormant” in the event that they fail to “participate” in the Site. “Participation” is defined as maintaining a minimum of 1 rating star. (A rating star requires a minimum of 40 quality rates within the last 90-day period. Please see the MandalayGazette.com Star Levels page for more information on rating stars.) If a member fails to maintain 1 rating star, his or her Account will become “dormant,” which means the member will cease to earn additional revenue share until such time as their Account is re-activated through participation. If an account is classified as dormant, prior earnings are not lost (other than as outlined herein), and the Account can be reactivated by the member at any time by participating as outlined herein.
Incentive Pay: All titles eligible for Incentive Pay are located in MandalayGazette.com’s Content Source identified by beginning with “MandalayGazette.com” and followed by the channel name. One article will be selected to earn the Incentive Payment, which is the amount listed in Content Source. Article selection and acceptance will be determined by a combination of editor grading, member rating and staff input. The selected and accepted articles will transition to MandalayGazette.com along with the title.
Incentive Pay will differ for each title, depending on factors such as the complexity of topic, SEO value and amount of research expected. Additionally, all articles on MandalayGazette.com will continue to accrue earnings based on the ad revenue share system.
Content Source: MandalayGazette.com’s Content Source offers writers the ability to compete for freelance writing assignments from publishers. On any given day, hundreds of assignments may be listed in the “My Assignments” section on your My MandalayGazette.com page. Writers whose articles are selected are paid the specified payment. No rating stars or writing stars are required for payment. Please note, some Content Source writing assignments are restricted to Marketplace Premier writers, starred writers or other pre-qualified participants.
Stock Content: All content published on MandalayGazette.com is available for non-exclusive, limited rights licensing by publishers. If a publisher, such as a newsletter or newspaper wishes to use an article they find on MandalayGazette.com, MandalayGazette.com will license the work and make payments to the writer. Please note, this product offers non-exclusive, limited rights to the publisher. In the event of a transaction, the writer retains copyright for their work and maintains their rights to republish and resell their content.
You agree not to initiate a contact with the publisher directly. Publishers are working with MandalayGazette.com because they do not have the time to work individually with freelancers. Your contacting a publisher directly will not reflect well on you and will endanger the future of this publisher working with MandalayGazette.com to provide assignments to many of our writers.
Contests: MandalayGazette.com and its publishing partners typically run one or more writing contests each month. These contests allow our members to compete against each other for fun, bragging rights and some much appreciated cash bonuses. Winners are paid based on the quality of their work. No writing or rating stars are required for payment.
How-To Guide Managers:
Members of the How-To Community have the opportunity to earn payments related to How-To Guides that they “Manage.” If you are a member in good standing of MandalayGazette.com and in the How-To Community, then you may earn revenue based on How-To Guides for which you are the manager. The payments are paid based on the number of Valid Views of the How-To Guide while you are the manager. A member of the How-To Community can create and own an unlimited number of How-To Guides.
The current payment is $1.00 for every 1,000 Valid Views for each Guide for which you are the manager. Payments will be accrued to your account on a monthly basis.
Member of the How-To Community: To maintain manager status of a How-To Guide, it is imperative to answer and handle any inappropriate reports, respond to questions from the “Ask the Author” block within a timely manner, and continue to be a member in good standing of MandalayGazette.com. If you do not handle inappropriate reports or “Ask the Author” questions, then you may be removed as manager of the specific How-To Guide in question. MandalayGazette.com may at any time determine that a How-To Guide is being neglected or not being properly maintained and can remove the manager from the page and can also reassign it to another manager. MandalayGazette.com may at any time determine that a member of the How-To Community is not participating appropriately and can remove him or her from the How-To Community.
Additional details (fine print) regarding payments on MandalayGazette.com:
Members can view their current balance by logging into their account. You hereby agree that you have no legal right, and will not be paid any amount, unless and until your earnings balance reaches the minimum payout threshold (“Minimum Payout Threshold”) (which is currently set at $25, and is subject to change by MandalayGazette.com in its discretion). Once a member reaches the Minimum Payout Threshold, he/she is entitled to receive the amount set forth in the earnings balance and may withdraw his/her earnings from his/her Account. If you have achieved the Minimum Payout Threshold but you do not participate on MandalayGazette.com for at least 365 days (12 months), you understand and agree that you forfeit any and all right you have to any accrued but unclaimed earnings. In the event that your account has not reached the Minimum Payout Threshold, you agree that you are not entitled to payments from MandalayGazette.com.
So, in plain English: MandalayGazette.com is a site that depends on members writing and rating. You can only earn ad revenue share when you have at least one Rating Star. If you return to MandalayGazette.com and regain a Rating Star within 12 months of the date of your last participation, your account balance will still be in place, and you will start earning again. However, if you do not participate by maintaining a rating star on MandalayGazette.com for a full 12 months, you will lose any accrued earnings in your account. The payment calculator we use to determine your earnings is based on proprietary technology we have developed. While we believe that this system will work for the foreseeable future, we want to continue to bring you the most up-to-date technology and calculation models possible. For that reason, we reserve the right to change the program, or the conditions of participation, at any time, with or without notice to you. Any changes will be reflected in this Agreement.
In the event of your death, your Account and the right to continue to receive earnings for the services and content you provided to MandalayGazette.com may be transferred to your heirs in accordance with this Agreement and applicable law; provided, however, in order to continue to receive earnings from your MandalayGazette.com contributions your heir(s) must remain active on the site and agree to be subject to this Agreement. The transfer to your heir(s) of the Account and the right to continue to receive earnings from your content is conditional upon your heir(s) providing MandalayGazette.com with legal proof of death, in its discretion, and your bequest of your Account within six months of your death. Failure to provide such proof in a form as agreed to by MandalayGazette.com will render any such transfer null and void.
6. Content submission requirements and terms
The following list outlines the rules for content submissions on this Site. Please follow these rules; if you don’t, MandalayGazette.com will likely be forced to cancel your Account.
Right to content: You must have all necessary rights to publish the content you provide to the Site. You represent and warrant that the works you submit are works of your own original authorship. If the content is not a work of your own original authorship, for example if you are submitting work as an agent or if your work contains third-party materials, you must have explicit written permission from the copyright owner before submitting the content to MandalayGazette.com. You are responsible for making sure your submission of the content, and the use as outlined herein by MandalayGazette.com, does not violate any copyright, trademark, trade secret or other rights or the privacy of others, including the right to transmit the content you provide to the MandalayGazette.com site and for MandalayGazette.com to publicly display such content.
Compliance with the law: In submitting articles and other content on this Site, you agree to comply with all laws, statutes and regulations of your jurisdiction, all contracts to which you are a party, and all fiduciary obligations you may have (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
Adherence to MandalayGazette.com review process: You accept that MandalayGazette.com and any other user of the Site can review and use the content you provide in accordance with these terms, including the terms of the Site Usage Requirements above.
Anonymity of postings: To ensure an anonymous and fair rating process, you may not include your name in the content of any article you submit. Nor may you include any other information or references that may enable any individual rating your article to identify you as the author. Outside of the rating process, your articles are automatically displayed with your pen name as a byline. Your pen name links to your “About Me” page, which we encourage you to complete and keep updated.
Non-harassing/non-violation of third-party rights policy: You agree to keep a respectful manner and conduct, and in particular you agree not to post or hyperlink to content that contains libelous or unlawful material, obscenity or any form of pornography, or information that may be used to cause harm or injury; harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, or obscene communications; or information that is invasive of another’s privacy, such as including a person’s name or recognizable description of a real person in an article. You further agree not to use the Site to “stalk” or otherwise harass any person, and not to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity.
Your promotion of the Site and MandalayGazette.com’s name: You may not create or distribute information, including but not limited to advertisements, press releases or other marketing materials, or include links to any sites which contain or suggest an endorsement by MandalayGazette.com without the prior review and written approval of MandalayGazette.com; however, you may accurately disclose and describe your participation in this Site and content you submit (for example, describing and promoting your content on this site on a personal blog, in emails, in newsgroups and forums, or via RSS feeds and similar technologies).
Non-spamming policy: You may not encourage the sending of “junk mail,” “spam,” “chain letters,” “pyramid schemes,” etc., either within the content you post, on the Site or otherwise.

7. Indemnity
You agree to indemnify and hold MandalayGazette.com, Inc., and its subsidiaries, affiliates, officers, agents, and employees, harmless from any claim, damage, expense or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (a) materials that you submit, post, or upload to the Site, (b) your use of the Site, (c) your connection to the Site, (d) your violation of this Agreement, (e) your violation of any rights of another party, or (f) violations to this Agreement or the rights of a third party by your dependents.
8. MandalayGazette.com intellectual property and proprietary rights
You acknowledge and agree that the materials available on the Site, including art work, graphics, photographs, images, screen shots, text, music, digitally downloadable files, video clips, trademarks, logos, product and character names, slogans, the software used in connection with the Site, and any compilations of the foregoing (“MandalayGazette.com Content”) contain proprietary and confidential information that is the property of MandalayGazette.com and its licensors, and is protected by applicable U.S. and international intellectual property and other laws.
